This privacy notice for Tidelas LLC ("Company," "we," "us," or "our"), describes how and why we might collect, store, use, and/or share ("process") your information when you use our services ("Services").

We collect personal information that you voluntarily provide to us when you contact or register for the Services. We may also collect information when you access and use our Services. Please Note: We offer our Services for users in North America only. We will refer to information about individuals as “Personal Information” or “Personal Data.”

The personal information we collect may include:

  • usernames;
  • passwords;
  • contact preferences;
  • contact or authentication data; and
  • Content, such as any postings you make on the Services

Information automatically collected.

We may automatically collect certain information when you visit, use, or navigate the Services. This information may include:

  • If you are on a mobile device, your general location;
  • An ID number we may assign to your device, or the ID number provided by your device;

We use this information to improve the Services to you, for internal analysis, and to maintain the security and operation of our Services.

  • We will share your information with third-party providers who help us operate our business, such as payment processing, web hosting, and data servers. This providers may only use your information to provide the Services to us and you.

4. LOCATION.

You understand and agree that Tidelas is a location-based service. We may use or save location information to provide our users with useful services when they interact with our Services, such as providing locally relevant and faster information results and suggestions that consider a person’s information needs, such as, for example, the best spot to launch an electric hydrofoil, kite board, or wing foil.

If you have previously consented to these uses, you may revoke that permission at any time through your device’s operating system location preference controls or, in some cases, the app settings. You may also follow the standard uninstall process to remove the Services from your device.

5. COOKIES.

We use “cookies” and equivalent technologies to collect information through our Services. Cookies are small data files stored on your device that act as a unique tag to identify your browser.

We may use cookies to identify that your web browser has accessed aspects of the Services and may associate that information with your account if you have one.

Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. We recommend that you leave cookies active, because they enable you to take advantage of the most attractive features of the Services.

This Privacy Policy covers our use of cookies only and does not cover the use of cookies by third parties. We do not control when or how third parties place cookies on your computer.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. KEEPING INFORMATION SAFE.

We will use reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

8. WE DO NOT COLLECT INFORMATION FROM MINORS.

Our Services are intended for businesses in the United States. The Services are not intended for, or directed at, minors. We do not knowingly solicit data from children under 18 years of age. By using the Services, you represent that you are at least 18. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 9. YOUR CHOICES.

Withdrawing your consent: You have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying "STOP" or "UNSUBSCRIBE" to the SMS messages that we send, or by contacting us using the details provided below. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

10. ACCOUNT INFORMATION.

If you would at any time like to review or change the information in your account or terminate your account, you can:

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

11. CONTROLS FOR DO-NOT-TRACK FEATURES.

We do not currently respond to Do-Not-Track browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

12. STATE LAW REQUIREMENTS.

In addition to your rights under other sections under this policy, you may be entitled also to the following specific rights under specific state laws in the USA such as California:

  • A right to request that we provide certain information to you about our collection and use of Personal Data related to you over the past 12 months. Upon verification of your request, and only if required under applicable state law, we will disclose to you:
    • The categories of Personal Data we collected about you;
    • The categories of sources for the Personal Data we collected about you;
    • Our business or commercial purpose for collecting that Personal Data;
    • The categories of Personal Data that we disclosed for a business purpose, and the categories of third parties with whom we disclosed that category of Personal Data;
    • The specific pieces of Personal Data that we collected about you;
    • If we disclose Personal Data related to you for a business purpose, we will provide you with a list which will identify the Personal Data categories that each category of recipient obtained.
    • You have the right to request that we delete any Personal Data related to you. Upon confirmation of your request, we will delete Personal Data related to you from our records, unless an exception applies.
    • You also have a right not to be discriminated against for exercising your rights under applicable state law.

13. UPDATES TO OUR POLICY.

We may update this privacy policy from time to time. The updated version will be indicated by an updated "Revised" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
